Yes, using Online Notary to notarize your documents is legal in Texas. It has been since 2018 in which Texas was the third state to add remote online notarization as a legal notary option.
-Texas Online Notarization Law: In Texas, remote online notarization is legal thanks to Chapter 406, Subchapter C of the Texas Government Code. This means notaries can work from anywhere online, with all the same legal powers as in-person notaries. They just need a special online commission and to follow the rules for online notarization.
-Out-of-State Notarizations: Texas is cool with notarizations done online by notaries from other states. This is backed by Chapter 602 of the Texas Government Code. Plus, the Full Faith and Credit Clause of the U.S. Constitution makes sure a notarization from any state works in Texas too.
-Digital Signatures: The U.S. Electronic Signatures in Global and National Commerce Act gives the thumbs up to digital signatures. That means an electronic signature is just as official as writing your name on paper.
Based on regulations, Texas Government Code Section 406, remote online notary fees can cost a cap of $25 per seal in addition to the regularly notary charges. Please view our pricing below for more detailed information.
